In the last panel, Fudo doesn't say this, but it is actually something both he and Raidon are aware of. It does make a difference. Jail would be hell. Fudo would never survive until execution. (Even Seiko knew this.) The convicts hate him because he was known for targeting criminals, and the guards hate him because he once killed a guard in an escape. He was also incriminated in the recent death of a police officer.

patrick: Raidon's the coolest. :-P

ghostrunner: Exactly.

n_y_japlander: It's not a bad deal.

Peipei: It might be the servitude that leaves a sour taste in his mouth. Live free or die!

Tantz: Ah. I get that. That is a bit of a cop out. That's not quite what I was thinking of for this story. Kaida and Fudo both are able to remember quite a bit, but if it doesn't fit into their accepted reality, they dismiss it. For example, Kaida "knows" Fudo is evil, so if she recalls a tender moment, it must be a deception. However, she has no problems remembering Toyo, because there is no such conflict.

amanda: It might not have to do with intelligence as much as Fudo's natural tendency to rebel.

Jonko: Originally, I had considered him accepting such a proposal, but it's contrary to his nature. Even an honest deal would likely be rejected.

DAJB: Indeed he does!

JustNoPoint: I almost had him accept. I had a plot direction planned and everything, but it's not in his nature. It's not that he's a moral man. He simply despises being ruled. He's a rebel through and through.
